Terms of Service — Hostess Webs

These Terms of Service (“Terms”) govern your use of Hostess Webs, including our Facebook / Meta Messenger assistant, intake form, preview sites, payments, domain assistance, and live portfolio hosting (the “Service”).

By messaging our Page, submitting our form, paying a deposit or final fee, or using a preview / live site we provide, you agree to these Terms.

If you order under those Polish documents, they prevail for pricing, delivery steps, complaints, and consumer rights under Polish law. These English Terms describe the Service for Meta / international users and summarize the same product.

Hostess Webs is an early-stage business operating under this brand. We are not yet a registered company in the Polish commercial register. These Terms are a practical service agreement — not a substitute for formal legal counsel.

1. What Hostess Webs is

Hostess Webs helps create and host a professional portfolio website for hostesses, promotional models, and event professionals. A typical flow:

  1. You contact us on Messenger (or another channel we offer).
  2. You receive a link to our intake form and submit profile, experience, photos, and optional short videos.
  3. After the deposit is paid and materials are complete, we prepare a preview.
  4. You leave feedback in the review window; we apply agreed corrections within package scope.
  5. You pay the final fee and the first hosting subscription period, confirm a domain, and we publish a live site.
  6. Ongoing hosting continues as a monthly or yearly subscription while active.

Exact prices and inclusions are those shown in the Oferta / Regulamin / Stripe Checkout at the time of purchase. Indicative package (gross, as in Oferta / Regulamin):

Extra work outside the package is quoted individually.

2. Who may use the Service

You must:

  • be at least 16 (or the age of digital consent in your country);
  • provide accurate information;
  • have the right to use the content you upload (photos, videos, logos, text, social links).

You may not use the Service for illegal, deceptive, or abusive purposes.

3. Messenger and automated messages

Our Page may use an automated assistant to:

  • greet you and collect your intent;
  • send a form link with a reference code;
  • send transactional updates (preview, payment, domain, go-live);
  • escalate to a human when needed.

Messenger delivery depends on Meta. If a message cannot be delivered, we may use email (if you provided one) or another channel you shared with us.

You are responsible for the content of messages you send us.

4. Intake form and your content

4.1 What you submit

You may submit personal and professional information, text, images, and videos. You confirm that:

  • the information is true and not misleading;
  • you own the rights or have permission to use all uploaded media;
  • people depicted (if any) have consented where required by law;
  • content does not infringe third-party rights or contain illegal material.

4.2 License to us

You grant us a worldwide, non-exclusive license to store, process, resize, convert, and display your content only to operate Hostess Webs: build previews, publish your portfolio, send you service communications, and provide support.

We do not claim ownership of your photos, videos, or bio text. You keep your rights.

4.3 Our templates and code

Site templates, design systems, automation, and software remain our intellectual property (or that of our licensors). Paying for a Hostess Webs package buys the service and hosting arrangement described in your order, not ownership of our platform source code unless a separate written agreement says otherwise.

4.4 Public portfolio

A live portfolio is typically public on the internet. Do not upload content you are not willing to show publicly. We may refuse or remove content that appears illegal, unsafe, or clearly rights-infringing.

5. Preview, deposit, feedback, and final payment

5.1 Timing (from Regulamin)

Indicative service windows (extend if you delay materials or approvals):

  • draft preview within about 48 hours after complete materials and deposit clearance;
  • after you submit feedback, final version within about 48 hours;
  • publish after full payment for the build (and first subscription period as agreed).

5.2 Deposit

Realization starts after the 199 zł deposit clears. The deposit reserves work. Unless mandatory consumer law says otherwise, deposits are generally non-refundable once work has started. If we cancel for our own operational reasons before delivering a usable preview, we will refund the unused deposit or offer an equivalent remedy.

5.3 Feedback

You may request reasonable corrections within package scope via the preview notes tool (or the channel we provide). Requests far outside the package (new features, redesigns, extra languages, custom apps, etc.) may require an extra fee or be declined. Feedback submitted after you confirm “done” may count as a new round or paid extra work.

5.4 Unpaid or abandoned orders

If you do not complete deposit or final payment within the timeframes we communicate (including reminders):

  • payment links may expire and need renewal;
  • the preview may be gated or closed;
  • we may eventually dispose of temporary preview resources while keeping records needed for legal / ops purposes.

5.5 Final payment and go-live

The 200 zł final build payment (and first subscription charge as applicable) is required before production publish. Until payment clears, we have no obligation to keep a public live site.

6. Domains

  • You already own a domain — you must point DNS / nameservers as we instruct.
  • We help register a domain — typically after final payment; the first year is included in the build price and registered on the client’s data so you remain the domain owner. Renewals after year one are your responsibility at registrar rates.

Availability is never guaranteed until registration succeeds.

7. Hosting subscriptions

Live hosting requires an active subscription (39 zł / month or 399 zł / year).

Included while active (per Oferta / Regulamin): hosting, maintenance, technical updates, support for site operation issues, and up to 1 content-change package per month (max 12 / year). Unused monthly change packages do not roll over.

  • Billing continues until canceled according to the plan (e.g. Stripe Customer Portal).
  • Failed payments may trigger reminders; prolonged non-payment may suspend change requests / support and later take the site offline (Regulamin: reminders and suspension ladders after overdue periods).
  • Voluntary cancelation: typically 30 days’ notice by email; after the paid period ends, hosting stops and the site goes offline. Domain ownership remains yours if renewals are paid.
  • After offline / end of cooperation, disposable hosting materials may be deleted after a retention window (~30 days unless law requires otherwise).

8. Payments

Payments are processed securely by Stripe (cards, and other methods Stripe enables such as BLIK / wallets where available). By paying, you also accept Stripe’s terms for card processing.

Prices are shown before checkout. Currency is as shown in Checkout (typically PLN).

Chargebacks filed without contacting us first may result in suspension of Service while we investigate.

9. Acceptable use

You agree not to:

  • abuse Messenger, forms, or payment links (spam, scraping, fraud);
  • upload malware, illegal content, or material you do not have rights to;
  • attempt to break into our systems, webhooks, or other customers’ sites;
  • impersonate others or misrepresent affiliations;
  • use the Service to harass or harm others.

We may suspend messaging replies, previews, or live sites if we reasonably believe these rules were broken.

10. Support

Support is provided primarily via Messenger and/or email (kontakt@hostesswebs.pl). Response times are best-effort, not a guaranteed SLA, unless a separate written SLA exists.

Complaints under Polish consumer rules follow the process in the Regulamin (email with identifying details; response within about 14 calendar days).

11. Third-party services

The Service depends on third parties, including Meta, Tally, Stripe, Supabase, Cloudflare, email providers, and domain registrars. Their outages or policy changes may affect Messenger delivery, forms, payments, DNS, or hosting. We are not liable for failures solely caused by those providers, beyond what mandatory law requires.

12. Disclaimers

To the maximum extent permitted by law:

  • the Service is provided on a practical “as available” basis;
  • we do not guarantee uninterrupted Messenger delivery, specific search rankings, or unlimited traffic;
  • portfolio results depend on the quality and legality of content you provide.

Nothing in these Terms limits liability that cannot be limited under applicable consumer protection law.

13. Limitation of liability

To the maximum extent permitted by law, our total liability arising from a given order is limited to the fees you paid us for that order in the 12 months before the claim (or a smaller amount if required by law for that claim type).

We are not liable for indirect, incidental, or consequential damages (lost profits, lost data beyond reasonable backups we choose to keep, reputational harm), except where mandatory law says otherwise.

14. Indemnity

If your content or use of the Service causes a third-party claim (e.g. copyright complaint about a photo you uploaded), you agree to cooperate with us and, to the extent permitted by law, cover reasonable costs arising from that claim where you are at fault.

15. Changes to the Service or Terms

We may improve features, security, and automation. We may update these Terms by posting a new version with a revised Last updated date. Material changes affecting paid customers will be communicated where practical (Messenger/email). Continued use after the effective date constitutes acceptance where allowed by law.

Polish Regulamin changes for active subscribers follow the notice rules in that document (typically at least 14 days by email).

16. Termination

You may stop using Messenger and cancel hosting via the methods we provide (email / Stripe portal / Regulamin notice rules).

We may suspend or end Service for unpaid fees, Acceptable Use violations, legal risk, or prolonged inactivity on unpaid previews.

Sections that by nature should survive (payments owed, IP, liability limits, indemnity) survive termination.

17. Governing law

These Terms are governed by the laws of Poland, without prejudice to mandatory consumer rights in your country of residence if you are a consumer.

Disputes should first be resolved amicably. Otherwise, courts competent under Polish law apply, unless mandatory consumer law gives you another forum.
